FORCE MAJEURE POLICY

This Force Majeure Policy applies to all services provided by Kathmandu Sightseeing and outlines circumstances under which performance may be delayed, modified, or suspended due to events beyond reasonable control.
1. DEFINITION OF FORCE MAJEURE
“Force Majeure” refers to any event or circumstance beyond the reasonable control of Kathmandu Sightseeing, including but not limited to: - Natural disasters (earthquakes, floods, landslides, severe weather) - Acts of God - Epidemics or pandemics - Government actions, regulations, or restrictions - Political unrest, strikes, protests, or public disturbances - Road closures, traffic restrictions, or infrastructure failures - Acts of terrorism or security threats
2. EFFECT ON SERVICES
- In the event of a Force Majeure occurrence, Kathmandu Sightseeing may delay, modify, reroute, suspend, or cancel services without prior notice.
- Routes, schedules, stops, and operating hours may be altered to ensure passenger safety and operational feasibility.
3. LIMITATION OF LIABILITY
- Kathmandu Sightseeing shall not be held liable for any loss, damage, inconvenience, or expense arising from Force Majeure events.
- The Company’s failure or delay in performance under such circumstances shall not constitute a breach of contract.
4. REFUNDS & ALTERNATIVES
- Force Majeure events do not automatically entitle passengers to refunds.
- Where reasonably possible, Kathmandu Sightseeing may offer alternative arrangements, rescheduling, or extensions at its discretion.
5. PASSENGER RESPONSIBILITY
- Passengers are responsible for monitoring official communications, announcements, and updates provided by Kathmandu Sightseeing.
- Passengers are advised to plan accordingly and maintain flexibility during unforeseen events.
6. GOVERNING LAW
- This policy shall be governed by and interpreted in accordance with the laws of Nepal, with courts of Kathmandu having exclusive jurisdiction.
